4.1: Account Creation

By submitting User Content, you grant Tailmate a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any media formats and through any channels.

5.2: Content Standards

You agree that your User Content will:

• Be accurate and truthful based on your actual experience
• Not violate any laws or regulations
• Not infringe on the intellectual property, privacy, or other rights of any third party
• Not contain harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable material
• Not contain spam, advertising, or promotional content unless explicitly authorized by Tailmate
• Not contain malicious code, viruses, or any other harmful components

5.3: Content Moderation

We reserve the right, but are not obligated, to:

• Monitor, review, and moderate User Content
• Remove or modify any User Content that violates these Terms
• Remove User Content for any reason at our sole discretion

5.4: Photo Uploads

When you upload photos to the Service:

• You represent that you own the photos or have the right to upload them
• You grant us the right to display, reproduce, and distribute the photos
• You understand that photos may be resized or reformatted for display purposes
• We may remove photos that violate our content guidelines or these Terms

7.1: Information Accuracy

We aggregate restaurant and business information from various sources, including third-party data providers and user submissions. While we strive to provide accurate information, we cannot guarantee the accuracy, completeness, or timeliness of all information on the Service.

7.2: No Endorsement

Listing a business on Tailmate does not constitute an endorsement or recommendation by Tailmate. We do not verify the quality, safety, or pet-friendliness of any listed business.

7.3: User Responsibility

You are responsible for:

• Verifying information before visiting a business
• Confirming pet policies directly with businesses
• Ensuring your pet is well-behaved and appropriate for the venue
• Following all applicable laws and business policies

8.1: Tailmate's Rights

The Service, including its design, features, text, graphics, logos, and software, is owned by Tailmate and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

8.2: Trademarks

"Tailmate" and related logos are trademarks of Tailmate. You may not use these trademarks without our prior written consent.

10.1: Service "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TAILMATE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2: No Warranty of Accuracy

WE DO NOT WARRANT THAT:

• The information on the Service is accurate, complete, or current
• The Service will be uninterrupted, secure, or error-free
• Any defects or errors will be corrected
• The Service is free of viruses or harmful components

10.3: Restaurant Information

WE MAKE NO REPRESENTATIONS OR WARRANTIES ABOUT THE PET-FRIENDLINESS, SAFETY, OR QUALITY OF ANY BUSINESS LISTED ON THE SERVICE. USE OF THE SERVICE AND VISITS TO ANY LISTED BUSINESS ARE AT YOUR OWN RISK.

IN NO EVENT SHALL TAILMATE'S TOTAL LIABILITY TO YOU EXCEED ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID TO TAILMATE IN THE PAST SIX MONTHS, WHICHEVER IS GREATER.

15.1: Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

15.2: Informal Resolution

Before filing a formal dispute, you agree to contact us at legal@hellotailmate.com to attempt to resolve the issue informally.

15.3: Arbitration

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Delaware. You and Tailmate agree to arbitrate all disputes on an individual basis and waive any right to participate in a class action.

15.4: Exceptions

Either party may bring a lawsuit in court for injunctive relief or to enforce intellectual property rights without first engaging in arbitration.

16.1: Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tailmate regarding the Service.

16.2: Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16.3: Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

16.4: Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer these Terms at any time without notice.

16.5: No Agency

Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and Tailmate.
